Project KickStart requires that all the visitors to our site on the World Wide Web ("Site") adhere to the following rules of use. By accessing this site you indicate your acknowledgment and acceptance of these terms and conditions.
Laws
User access to and use of the Site is subject to all applicable federal, provincial and local laws and regulations.
Keystroke's Obsolescence Policy is to support the current release of a particular product, and in most cases, the prior two releases, for a reasonable period of time to be determined by Keystroke. Support of a product includes customer support, product availability for sale, and any other services we offer that relate directly to that product. Exceptions may apply to this policy on an individual product basis.
Customers using unsupported products are encouraged to upgrade to a supported version. Keystroke reserves the right to discontinue the sale and support of all unsupported versions of it's software products.
Copyrights and Trademarks
The trademarks, logos and graphics ("trademarks") displayed on the Site are the property of their respective owners. Users are prohibited from using any trademarks without the written permission of Keystroke.ca or such third party which may own the trademarks. All content on the Site is protected by copyright. Users are prohibited from modifying, copying, distributing, transmitting, displaying, publishing, selling, licensing, creating derivative works or using any content on the Site for commercial or public purposes.
No Warranties
ALL INFORMATION ON THE SITE IS PROVIDED TO YOU "AS IS" WITHOUT WARRANTY OF ANY KIND EITHER EXPRESS OR IMPLIED INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SECURITY OR ACCURACY. Project KickStart does not endorse and is not responsible for the accuracy or reliability of any opinion, advice or statement made through the Site by any party. Other than as required under consumer protection law, under no circumstance will Project KickStart be liable for any loss or damage caused by a user's reliance on information obtained through the Site. It is the responsibility of the user to evaluate the accuracy, completeness or usefulness of any information, opinion, advice or other content available through the Site.
Limitation of Liability
Project KickStart specifically disclaims any liability (whether based in contract, tort, strict liability or otherwise) for any direct, indirect, incidental, consequential, or special damages arising out of, or in any way connected with access to or use of the Site, (even if Project KickStart has been advised of the possibility of such damages) including liability associated with any viruses which may infect a user's computer system.
Merchandise Availability
All merchandise sales are subject to availability. If an order is not available, a similar item of equal value will be substituted whenever possible. If a substitution is not available, your account will be credited back to you and you will be contacted.
Merchandise prices and availability are subject to change without notice. New merchandise will be added to the Project KickStart shopping cart on a regular basis.
Some items are available in limited quantities. Limited items will be so noted in the product description.
Merchandise Delivery (if applicable)
Most of our software products are available immediately via download link provided in advance or after purchase.
For hard goods, please allow 2-4 weeks for delivery. Customers may be required to provide a signature when products are delivered. Some items may have longer delivery times – this will be indicated.
Orders are shipped via courier and require complete mailing address and telephone number for daytime delivery (orders cannot be shipped to a post office box).
If your product arrives damaged, has missing pieces or is the incorrect item, please contact us immediately.
In cases of software purchases, no installation media will be provided unless expressly indicated in the product description. You will receive a link to a software download site or login location, and be provided license information and/or login credentials.
Merchandise Returns
It is our policy at Project KickStart to provide the best service, information, and support before and after a sale so that our customers can be happy with their purchase, and their business experience with us. However, as a 14-day trial period is provided with our product to help determine our products suitability, refunds or credits after purchae are not available. Keystroke reserves the right, in its exclusive discretion, to offer refunds, credits, or exchanges where circumstances warrant, but these are decided on a case by case basis.
We generally do not refund or exchange in these circumstances
- Just because you made a 'mistake' when ordering.
- Just because you changed your mind after ordering.
- The hardware or software you purchased did not meet your intended business use. Project KickStart never guarantees "fitness of use", as this determination is incumbent upon the customer to investigate.
- Refunds of technical support plans just because you never ended up needing support.

Project KickStart is not responsible for the content available on any other Internet sites linked to the site. Access to any other Internet sites linked to the Site is at the user's own risk.
Postings
Project KickStart is under no obligation to review any messages, information or content ("Postings") posted on the Site by users and assumes no responsibility or liability relating to any such Postings. Notwithstanding the above, Project KickStart may from time to time monitor the Postings on the Site and may decline to accept and/or remove any Postings that contain:
Any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, profane, hateful, racially, ethnically or otherwise objectionable material of any kind, including, but not limited to, any material which encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national or international law.
Advertisements or solicitations of any kind
NOTE: This is not applicable for those Sites with message boards containing classified advertisements.
Messages posted by users impersonating others.
Personal information such as messages which state phone numbers, social security numbers, account numbers, addresses, or employer references.
Messages by non-spokesperson employees of Project KickStart purporting to speak on behalf of Project KickStart
Messages that offer unauthorized downloads of any copyrighted or private information.
Multiple messages placed within individual folders by the same user restating the same point.
Chain letters of any kind.
Personal Data
User acknowledges and agrees that by providing Project KickStart with any personal or proprietary user information through the Site, user consents to the transmission of such personal or proprietary user information over international borders as necessary for processing in accordance with Project KickStart standard business practices.
Changes to rules
Project KickStart reserves the right to revise these Rules and Regulations at any time and users are deemed to be apprised of and bound by any changes to these Rules and Regulations.
Violations of Rules and Regulations
Project KickStart reserves the right to seek all remedies available at law and in equity for violations of these Rules and Regulations, including the right to block access from a particular Internet address to the Site.
Access to password protected/secure areas
Access to and use of password protected and/or secure areas of the Site is restricted to authorized users only. Unauthorized individuals attempting to access these areas of the Site may be subject to prosecution.
